Flushing restaurant bankruptcy at building with alleged $52M contract: A longtime restaurateur filed for bankruptcy protection for the fourth time in six years, in an effort to halt a commercial eviction proceeding at 138-28 Northern Boulevard. The owner of KumGangSan claimed in court papers filed in 2020 as part of a state court action that he had a right of first offer to buy the parcel as a feature of his 20-year lease. He said in that filing that the property owner had a bona fide offer from an entity identified as SMI/DP Plus Property LLC to buy it for $52 million.
The restaurateur wanted to sell his contract rights for $4 million. An order of eviction was signed in September 2019 but was on hold pending an earlier bankruptcy. In January 2021, the warrant was entered and assigned to a city Marshal on February 4, 2021.Holdover
